1. Introduction

Welcome to EnsofAI ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of the EnsofAI mobile application (the "App"), which provides AI companion chat services and user-to-user matching features.
By accessing or using EnsofAI, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the App.

2. Eligibility

2.1 Age Requirement

You must be at least 18 years of age to use EnsofAI. By using the App, you represent and warrant that you are at least 18 years old. We reserve the right to verify your age and terminate accounts that violate this requirement.

2.2 Account Responsibility

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Ensuring your account information is accurate and up-to-date
  • Notifying us immediately of any unauthorized use of your account

3. Description of Services

3.1 AI Companion

EnsofAI provides an AI-powered companion chat service. You acknowledge and understand that:

  • The AI companion is not a real person
  • The AI companion is not a substitute for professional medical, psychological, or therapeutic advice
  • Interactions with the AI are automated and generated by artificial intelligence
  • The AI companion's responses are based on algorithms and may not always be accurate or appropriate

3.2 User Matching and Connections

EnsofAI may facilitate connections between users based on compatibility algorithms. You understand that:

  • We do not guarantee the accuracy of match suggestions
  • We are not responsible for interactions between users
  • You are solely responsible for your conduct when communicating with other users
  • We reserve the right to monitor conversations for safety and compliance purposes

4. User Conduct

4.1 Prohibited Activities

You agree NOT to:

  • Use the App for any illegal purpose or in violation of any local, state, national, or international law
  • Harass, abuse, threaten, or intimidate other users
  • Share sexually explicit, violent, hateful, or discriminatory content
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with any person or entity
  • Share personal information of others without their consent
  • Attempt to gain unauthorized access to the App or its systems
  • Use the App to distribute spam, viruses, or malicious code
  • Scrape, data mine, or use automated tools to access the App
  • Engage in commercial activities or advertising without our written permission
  • Share content that infringes on intellectual property rights
  • Attempt to manipulate or exploit the AI for harmful purposes

4.2 Content Standards

All content you share through EnsofAI must:

  • Be respectful and appropriate
  • Not violate any third-party rights
  • Comply with all applicable laws and regulations
  • Be truthful and not misleading

5. Intellectual Property

5.1 Our Rights

EnsofAI and its original content, features, and functionality are owned by EnsofAI and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

5.2 User Content

By sharing content through EnsofAI, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your content for the purpose of operating and improving the App. You retain all ownership rights to your content.

5.3 Restrictions

You may not:

  • Copy, modify, or create derivative works of the App
  • Reverse engineer, decompile, or disassemble the App
  • Remove or alter any copyright, trademark, or proprietary notices
  • Use our trademarks or branding without written permission

6. Subscription and Payment Terms

6.1 Premium Subscriptions

EnsofAI offers premium subscription features. By subscribing, you agree to:

  • Pay all applicable fees as described at the time of purchase
  • Automatic renewal of your subscription unless cancelled
  • Our right to modify subscription prices with advance notice
  • No refunds for partial subscription periods unless required by law

6.2 Billing

  • Subscriptions are billed in advance on a recurring basis (monthly, yearly, etc.)
  • Payment will be charged to your account at confirmation of purchase
  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
  • You can manage subscriptions and turn off auto-renewal in your account settings

6.3 Cancellation

You may cancel your subscription at any time. Upon cancellation:

  • You will retain access until the end of the current billing period
  • No refund will be provided for the remaining period unless required by law
  • Your account will revert to the free tier at the end of the billing period

6.4 Free Trial

  • If we offer a free trial:
  • You may be charged automatically when the trial period ends
  • You must cancel before the trial period ends to avoid charges
  • We reserve the right to limit free trial eligibility

7. Privacy and Data

Your use of EnsofAI is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

8. Termination

8.1 Termination by You

You may delete your account at any time through the App settings or by contacting us at founders.ensofai@gmail.com.

8.2 Termination by Us

We reserve the right to suspend or terminate your access to EnsofAI at any time, with or without cause, including but not limited to:

  • Violation of these Terms
  • Illegal or harmful behavior
  • Non-payment of subscription fees
  • Extended inactivity
  • At our sole discretion

8.3 Effect of Termination

Upon termination:

  • Your right to use the App will cease immediately
  • We may delete your account and content
  • Outstanding fees remain payable
  • Provisions that should survive termination (including intellectual property rights and limitations of liability) will continue to apply

9. Disclaimers

9.1 "AS IS" Service

ENSOFAI IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 No Professional Advice

The AI companion is not a licensed therapist, counselor, or healthcare provider. EnsofAI does not provide medical, psychological, or professional advice. Always seek the advice of qualified professionals for medical or mental health concerns.

9.3 User Interactions

We do not guarantee:

  • The accuracy or reliability of user-generated content
  • The conduct or safety of users you connect with
  • The compatibility or suitability of match suggestions
  • Uninterrupted or error-free service

9.4 Third-Party Services

We are not responsible for third-party services or content linked to or from EnsofAI.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY INDIAN LAW:

10.1 No Liability

ENSOFAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to:

  • Loss of profits, data, or goodwill
  • Service interruption
  • Computer damage or system failure
  • Cost of substitute services
  • Damages arising from user interactions
  • Emotional distress or psychological harm

10.2 Maximum Liability

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR ₹1,000 (ONE THOUSAND INDIAN RUPEES), WHICHEVER IS GREATER.

10.3 Essential Purpose

THE LIMITATIONS IN THIS SECTION APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.

11. Indemnification

You agree to indemnify, defend, and hold harmless EnsofAI, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your content or conduct on the App
  • Your interactions with other users

12. Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

12.2 Jurisdiction

You agree to submit to the exclusive jurisdiction of the courts located in [Your City/State, India] for the resolution of any disputes arising from these Terms or your use of EnsofAI.

12.3 Informal Resolution

Before filing a claim, you agree to contact us at founders.ensofai@gmail.com to attempt to resolve the dispute informally. We will attempt to resolve disputes in good faith.

12.4 Arbitration

If informal resolution fails, you agree that disputes shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996, before a sole arbitrator appointed by mutual agreement.

13. Changes to Terms

13.1 Modifications

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms in the App
  • Sending an email to your registered email address
  • Displaying a notice when you log in

13.2 Acceptance

Your continued use of EnsofAI after changes take effect constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the App and delete your account.

13.3 Effective Date

Changes will take effect immediately upon posting unless otherwise specified.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and EnsofAI regarding the use of the App.

14.2 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

14.3 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

14.4 Assignment

You may not assign or transfer these Terms or your rights under them without our written consent. We may assign these Terms without restriction.

14.5 Force majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, natural disasters, or government actions.

14.6 Notices

All notices to you will be sent to the email address associated with your account. Notices to us should be sent to founders.ensofai@gmail.com.

14.7 Survival

Provisions that by their nature should survive termination (including intellectual property rights, disclaimers, limitations of liability, and dispute resolution) will survive the termination of these Terms.
